Texas Supreme Court Dismisses SpaceX Beach-Closure Lawsuit

The Texas Supreme Court has dismissed a lawsuit challenging closures of Boca Chica Beach tied to SpaceX launch activity near Brownsville, but the ruling did not decide the broader question of whether the closures violate Texans’ constitutional right to access public beaches.

The case was brought by environmental and community groups that argued repeated closures of Boca Chica Beach and the road leading to it conflicted with the Texas Constitution’s public beach access protections. The beach sits near SpaceX’s Starbase launch site east of Brownsville, where Starship launches and testing can require temporary public-access restrictions for safety reasons.

According to reporting from the Houston Chronicle, the high court reinstated a trial court’s dismissal of the lawsuit. The court said the constitutional beach-access provision does not give private individuals or groups the right to enforce that provision through this kind of lawsuit.

That means the ruling turned largely on who has legal authority to bring the challenge, rather than whether SpaceX-related beach closures themselves are lawful. The court said it was not deciding whether the closures, or the state laws allowing them, violate the public’s right to access Texas beaches.
