McALLEN, Texas — A restored federal public-charge rule scheduled to take effect Sept. 18 is raising concern among immigration attorneys and advocates in the Rio Grande Valley, where mixed-status families may face new uncertainty when applying for lawful permanent residence.
The policy allows immigration officers to consider whether an applicant is likely to become primarily dependent on government assistance. Officers are directed to make an individualized decision based on the totality of a person’s circumstances, which can include age, health, family status, financial resources, education and skills.
The rule does not provide a definitive list of every benefit that may be considered. That lack of specificity has prompted warnings that eligible immigrants and their U.S.-citizen relatives could avoid medical care, nutrition programs or other assistance because they fear jeopardizing a future green-card application.
Federal law has long allowed the government to deny admission or permanent residence to someone determined likely to become a public charge. The Trump administration expanded the policy during the president’s first term, while the Biden administration later adopted a narrower standard. The restored approach gives adjudicating officers broader discretion.
U.S. Citizenship and Immigration Services has said the policy is intended to reinforce self-sufficiency and protect public resources. Immigrant-rights organizations contend the rule could function as a wealth test and create confusion even for people whose use of assistance would not ultimately disqualify them.
Because immigration cases depend on individual facts, applicants should not cancel benefits or make legal decisions based only on general reports. They may wish to consult a qualified immigration attorney or an accredited nonprofit representative before acting.
